Pre-contract information

This page sets out the key information you need before booking a vehicle on www.hertzstbarth.com (articles L. 111-1 and L. 221-5 of the French Consumer Code). The rental is governed by the general rental conditions (French, binding version), accepted when booking, and by the rental agreement signed at vehicle pick-up.

1. The rental company

HENRY'S CAR RENTAL, simplified joint-stock company (SAS) with a share capital of €7,622.45, RCS Basse-Terre 422 246 876, registered office Saint-Jean, 97133 Saint-Barthélemy (French West Indies), operator of the Hertz St Barth agency (Rémy de Haenen Airport, Saint-Jean). 2. Service

Short-term rental of passenger vehicles without driver, in Saint-Barthélemy only. Bookings are for a vehicle category: a similar vehicle of the same category may be provided. Photos are non-contractual illustrations.

3. Booking steps

• Choose dates, pick-up location and vehicle based on displayed availability;
• choose options and, if applicable, enter a promo code;
• enter the driver’s details and review the detailed total price;
• accept these terms and the privacy policy, then click “Book with obligation to pay”;
• a reservation number is displayed and a confirmation email is sent.

4. Prices

Prices are in euros, all taxes included; VAT is not applicable in Saint-Barthélemy. The total price shown before confirmation includes the rental for the selected period, the selected options, delivery fees and any promo code discount.

“From” prices are the lowest daily rate in the category; the actual price depends on dates, duration and availability and is always shown before confirmation.

Not included in the total price: fuel (vehicle supplied with a full tank, to be returned full, otherwise the missing fuel is charged), delivery outside opening hours (surcharge communicated and accepted beforehand), rental extensions, damage, excess, fines and penalties for which the renter is liable under the rental agreement. A 60-minute grace period applies at return; beyond it, an extra day is charged.

5. Payment and guarantee

No payment is taken online. The price is paid at the agency when you collect the vehicle, by the main driver, who must be the payer. A credit card with embossed numbers in their name is required (Electron and Maestro not accepted). A security deposit is mandatory at pick-up; its amount is stated in the rental agreement and it is released after return, less any sums due (article 8 of the general conditions).

6. Driver

The main driver and any additional driver must hold a valid driving licence and meet the age and licence seniority requirements for the booked category, available on request before booking. A young driver surcharge applies to drivers under 25. An international driving permit is required for non-EU licences not written in the Roman alphabet. Additional drivers must be declared on the rental agreement.

7. Insurance

The vehicle is covered by compulsory third-party liability insurance, which does not cover damage to the rented vehicle. The “Insurance” option reduces the renter’s financial liability for damage within the limits, excess and exclusions stated in the rental agreement, available on request before booking.

8. Pick-up and return

A joint vehicle condition report is completed at pick-up and return. The vehicle must be returned at the agreed place, date and time, in the condition in which it was supplied, apart from normal wear and tear.

9. Changes and cancellation

You can change or cancel your booking online on the Modify / Cancel page or by contacting the agency. No fee is charged if you cancel or change at least 24 hours before the pick-up time. A cancellation less than 24 hours before pick-up, or a no-show within 2 hours of the scheduled time (or of your flight landing, if provided), is charged the total amount of the booked rental. After this 2-hour period the booking is no longer guaranteed; a €45 late arrival surcharge applies (articles 4.2 and 4.6 of the general conditions).

Festive season: bookings with a pick-up date between December 15 and January 5 can no longer be cancelled within 30 days of pick-up. See the festive season cancellation policy.

10. Right of withdrawal

Under article L. 221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to car rental services provided on a specific date or for a specific period. The cancellation terms in point 9 above apply.

11. Complaints and mediation

Complaints can be sent to the agency (Phone : +590590277114 · Email : [email protected]) or by post to the registered office.

In accordance with articles L. 612-1 et seq. of the French Consumer Code, after a written complaint to HENRY'S CAR RENTAL that has not been resolved satisfactorily, consumers may refer the dispute free of charge to the consumer mediator of the FNA (Médiateur auprès de la FNA). 12. Personal data

13. Governing law and language

This information and the rental agreement are governed by French law. The French version prevails. Consumers may bring disputes before the court of the place where they lived when the contract was concluded or the harmful event occurred, or any other competent court.
